PRIVACY POLICY

Introduction

This Privacy Policy describes the types of personal information (a.k.a. “data”) Welch Workwear, member of the Kinco, LLC family of companies, and its parent, subsidiary, and affiliate companies (collectively, “Welch Workwear,” "Welch," “we,” or “us”) collects, as well as how it’s used, disclosed, protected, and retained through our website from which you are accessing this Policy, our social media pages on third-party social media platforms, email, text, mail, and any offline business interactions you have with us (collectively, our “Services”). It also explains your privacy choices and rights and how to exercise them. 
By accessing or using our Services, you signify your acceptance of this Privacy Policy and consent to the collection, use, disclosure, and other handling of your personal information as described in this Privacy Policy (except for activities for which we first require your consent to be given through other means). 

What type(s) of information is collected?

Welch Workwear collects and stores different types of information about you, including information that identifies, relates to, describes, or can be associated with you (known as “personal information”). This includes information we collect directly from you, through automated collection technologies, from other sources, or personal information we derive based on different types of personal information we collect, as described below.

In the preceding twelve (12) months, we have collected the following categories of personal information. Note that not all categories may be collected about every individual:

  • Identifiers (e.g., name, alias, postal address, unique personal identifier, IP address, email address, customer number, and other online identifiers)
  • Commercial Information (e.g., transaction information and purchase history records of products considered or other purchasing or consuming histories or tendencies, reviews you submit)
  • Internet or Network Activity (e.g., browsing history, interactions with our website, clicks)
  • Geolocation Data (e.g., device location)
  • Professional or Employment-Related Information (e.g., work email)
  • Audio, Electronic, Visual, or Similar Information (e.g., in-store Closed-Circuit Television (“CCTV”), customer experience calls, user-generated content)
  • Personal Information Categories Listed in the California Customer Records Statute (e.g., name, address, telephone number, personal characteristics or description, employment; some of this information may overlap with other categories)
  • Inferences drawn from any of the Personal Information listed above to create a profile about, for example, an individual’s preferences (e.g., preferences, interests, and characteristics)
  • Sensitive personal information (in limited circumstances and described further below)

Business Contacts, Vendors, and Contractors. As included in the abovementioned categories, we collect limited personal information from our business contacts, vendors, and contractors. For example, we collect name and business contact information from each of our business contacts, vendors, and contractors to initiate, operate, manage, and maintain our business relationships. For our business contacts, such as our dealers, we may also collect purchase or consumption histories as part of that relationship.

Do we collect sensitive personal information?

While Welch Workwear does not collect precise geolocation through our website or online services, our service providers may collect such information to find a store near you using your location data, which may be considered “sensitive personal information” or “sensitive data” within the meaning of the CCPA, Virginia Consumer Data Protection Act (“VCDPA”), and other US privacy laws. In most other cases, Welch Workwear does not ask you to provide, and we do not knowingly collect, any sensitive personal information (as defined under the CCPA, VCDPA, and other US privacy laws) from the typical consumer as part of the Services (e.g., social security numbers, information related to racial or ethnic origin, political opinions, religion or other beliefs, health, biometrics or genetic characteristics, criminal background, or trade union membership). Unless we request it, we ask that you not send us, and you do not disclose, any sensitive personal information on or through the Services or otherwise to us. In very rare circumstances, Welch Workwear does ask that you provide sensitive personal information in the form of a 1099 form solely for legal matters to allow us to facilitate sweepstakes and giveaways of Welch Workwear products above a specific monetary value. In addition, to participate in an investigation of unlawful conduct (e.g., fraud or counterfeiting), we may collect any personal information permitted by law, which, depending on the details of a particular investigation, could include any category of sensitive personal information.

We do not “sell” or “share” sensitive personal information about Californians or any other states’ residents within the meaning of the CCPA and other US privacy laws, and do not use “sensitive personal information” for any purposes that are incompatible with the disclosed purpose for which it was collected or other than those permitted purposes authorized by US privacy law.  

How do we use your personal information?

We and our service providers, contractors, and third parties use your personal information for the following purposes:

  • Provide, operate, and maintain our website
  • Fulfill orders and process returns that you have ordered or requested, and communicate about such orders or returns
  • Enable and improve customer service and address your questions, suggestions, compliments, or complaints
  • Communicate with you, including sending you important information regarding the website or terms, conditions, policies, recall information, and/or other administrative information
  • Share reviews, testimonials, or other user-generated content

  • Administer sweepstakes, contests, and promotions, including special discounts for friends and family, professionals, military personnel, veterans, nurses, first responders, and government officials

  • Enable our business purposes, such as data analysis, audits, researching and developing new products and services, identifying usage trends, enhancing this website, improving our services

Who does Welch Workwear disclose, share, and/or sell your personal information to, and for what purposes?


Welch Workwear may disclose, share, or sell your personal information to service providers, contractors, and third parties for one or more purposes as described below.

We disclose your personal information for a business purpose to the following categories of service providers and contractors:

  • Affiliates for the purposes described in this Privacy Policy.
  • Service providers engaged by Welch Workwear to facilitate a service on our behalf, such as order fulfillment, customer service, payment processing, and other services. See below for more information on our third-party payment processors.
  • Contractors that provide consultancy and advisory services, such as our third-party auditors.
  • Analytics, marketing, and advertising partners, such as performance marketing partners, database marketing partners, and social media providers, for the purpose of marketing services and products you might want.
  • Joint marketing partners are when we occasionally partner with another brand, retailer, or other party to offer co-branded or cross-promotional services, products, events, and promotions. The information you provide in connection with our Services may be collected directly by or shared with the partner and any participating sponsors or advertisers of such services.
  • Entities involved in a business sale or similar transaction where we may buy, merge, or partner with other companies.
  • Entities involved in the protection of Welch Workwear and other legal compliance, if required to do so by law or on a good faith belief that such disclosure is reasonably necessary to: (i) seek legal advice from Welch Workwear in-house or outside counsel or in connection with litigation with a third party; (ii) comply with law or legal process (e.g., a subpoena or court order) and requests from public or governmental authorities; (iii) enforce our Terms and Conditions, this Privacy Policy or other contracts with you, including investigation of potential violations thereof; (iv) protect the rights, property, or personal safety of Welch Workwear, its agents, affiliates, its users, and/or the public; (v) investigate security breaches; and (vi) allow us to pursue available remedies or limit the damages that we may sustain. This includes exchanging information with other companies and organizations for fraud protection, spam/malware prevention, and similar purposes.

Sharing and Selling of Personal Information

We do not sell consumers’ personal information for money. However, some US state laws broadly define “sales,” and certain sharing activities described below may be considered a sale under specific privacy laws even though we do not receive any financial compensation from third parties in exchange. Instead, we share certain personal information in exchange for insights and other valuable services. We also share personal information for cross-contextual behavioral advertising (also known as “targeted advertising”), e.g., to share advertisements with you based on personal information collected from your activities over time.

How long does Welch Workwear keep your data?

We plan to retain your personal information only for the period necessary to fulfill the purposes outlined in this Privacy Policy unless a more extended retention period is required or allowed by law. When we determine that we have no ongoing legitimate business need nor lawful legal ground to process your personal information, we will take steps to delete, anonymize, or aggregate it or, if this is not possible (e.g. because your personal information has been stored in backup archives), then we will store your personal information until deletion is possible.

Welch Workwear determines retention based primarily on the type of record being retained. However, because a particular category of personal information may appear in different types of records, each with different retention periods, it may not be possible to specify a universal retention period for each category of personal information. Instead, the criteria used to determine our retention periods include:

  • The length of time we have an ongoing relationship with you and provide the Services to you (e.g., for as long as you have an account with us or keep using the Services);
  • Whether there is a legal obligation to which we are subject (e.g., certain laws require us to keep records of your transactions for a certain period of time before we can delete them); or
  • Whether retention is advisable in light of our legal position (such as regarding applicable statutes of limitations, litigation, or regulatory investigations).

We collect personal information you provide to us, such as your name, phone number, and email address, for instance, when you:

  • Sign up to receive updates, special promotions, sweepstakes, campaigns, or newsletters from us by text, email, or postal mail
  • Opt-in to transactional texts for delivery updates on your order or inventory updates on your desired product. Such information, as well as your opt-in consent, is not sold or shared with any third parties

Information We Collect Automatically

We automatically collect certain personal information through a variety of different means (e.g., tracking technologies, WIFI, CCTV) when you access or use our Services, including:

We may receive personal information about you from other sources. We may combine that with information we have already collected from you for all the purposes described in this Privacy Policy. For example, we may collect personal information about you from:

  • Our other customers, including when they send you a Welch Workwear product
  • Social media providers, including if you interact with us through a social media service or log in using social media credentials

We seek to use various organizational, technical, and administrative measures to protect personal information within our organization. Unfortunately, no data transmission or storage system can be guaranteed 100% secure. What are your choices and legal rights?

We strive to provide you with choices regarding your personal information.

Your Choices

We have created the following mechanisms to provide you with control over your personal information.

  • Opt-Out of Email Communications. If you no longer want to receive marketing-related emails from us on a going-forward basis, you may opt-out by clicking the “unsubscribe” link at the bottom of any Welch Workwear marketing email. Please allow 30 days for the change to take effect. Note that if you opt-out of receiving marketing-related emails from us, we may still send you important administrative messages from which you cannot opt-out.
  • Opt-Out of Text Communications. You can opt-out of receiving further marketing text messages via the Messaging Service by responding to any of our text messages with any of the following replies: STOP, END, CANCEL, UNSUBSCRIBE, or QUIT. 
  • Opt-Out of Physical Mail Communications. If you no longer want to receive physical mail or catalogs from us on a going-forward basis, please contact us and we will update your records. 
  • Close Your Welch Workwear.com Account. If you wish to close your WelchWorkwear.com account at any time, please get in touch with us by contacting us via our website.
  • Manage Tracking Technologies and Advertising. We use several modern marketing tools to support our advertising efforts (see “From Where Does Welch Workwear Collect Personal Information?” above). You can manage how your device, mobile browser, and other devices share information with our website and how your browser handles cookies and other tracking technologies to collect information in connection with our Services and our advertisements. 
    • We may work with third-party advertising companies that collect and use information about your online activities across sites over time to deliver more relevant advertising when using Welch Workwear's Services and elsewhere on the Internet. You can learn more about interest-based advertisements and certain opt-out options from members of the Network Advertising Initiative (“NAI”) on its website (https://www.networkadvertising.org) and from members of the Digital Advertising Alliance on its website (https://digitaladvertisingalliance.org/).     • You may be able to block cookies on your browser. Please consult the “Help” section of your browser for more information.     • We use a tool on our website, The Osano Cookie Consent tool, which can be utilized to customize your cookie preferences. The tool will record when you have consented to our cookie policy and allows you to manage as you wish. Access your setting by visiting “Cookie Preferences” link in the site's footer. Essential cookies cannot be disabled. Note that existing settings are device- and browser-specific and may be reset upon clearing your cache or using a different device or browser. Your Legal Rights – California, Connecticut, Colorado, Utah, and Virginia Residents

If you are a California, Connecticut, Colorado, Utah, or Virginia resident, you may request or ask questions of us by following the below or by contacting us

  • Access. You have the right to know and request that Welch Workwear disclose certain personal information Welch Workwear holds about you, as well as details about whether and to whom your personal information was disclosed, shared, or sold, subject to certain exceptions. 
  • Deletion. You have the right to request that Welch Workwear and its service providers and contractors delete any personal information collected from or obtained about you, subject to certain exceptions.
  • Correction. You have the right to request that Welch Workwear correct any inaccurate personal information that we maintain, considering the nature of the personal information and the purposes of its processing. You can also review and change your personal information by signing into your account and visiting your “Account” page. Please note that we may be unable to accommodate your request if we believe it would violate any law or legal requirement or cause the information to be incorrect.
  • Portability. You have the right to obtain a copy of your personal information previously provided in a portable and readily usable format, to the extent technically feasible, subject to certain exceptions.
  • Opt-Out. You have the right to opt-out of the processing of personal information for the purposes of targeted advertising and of the “sale” / “sharing” of your personal information (as defined under the CCPA) by visiting www.WelchWorkwear.com/CCPA to process your request.  

You are also provided the right not to be discriminated against for exercising your rights.

Except for most opt-out requests, we cannot honor your request (such as to provide you with requested personal information) if we cannot verify your identity or authority to make the request and confirm that the personal information relates to you. Making a verifiable consumer request does not require you to create an account with us. We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

The verifiable consumer request must:

  • When appropriate, provide sufficient information that allows us to reasonably verify that you are the person about whom we collected personal information or an authorized representative (e.g., name, email, mailing address).
  • Describe your request with sufficient detail that allows us to understand, evaluate, and respond to it appropriately.

If you are a California, Colorado, Utah, Connecticut, or Virginia resident, you may designate an agent to exercise your rights on your behalf. We reserve the right to take steps to verify the agent's identity and that your agent has been authorized to make a request on your behalf. Such steps may include requiring that the agent submit a copy of a qualifying power of attorney or requiring you to confirm the request with us directly. For legal and security reasons, we do not accept requests requiring us to visit a website.

Appeals – Colorado, Connecticut, and Virginia Residents Only

Residents of Colorado, Connecticut, and Virginia have the right to appeal a decision concerning their privacy request—for example, you may appeal our decision to decline to take action on a request. To exercise your right to an appeal, please contact us. Upon receipt of such appeal, your appeal will be reviewed by our Privacy Team and, in certain circumstances, our General Counsel. We will respond with a decision and a written explanation of the reasons for the decision within 60 days of your appeal.

California “Shine the Light” Disclosure

California Civil Code Section 1798.83 (California’s “Shine the Light” law) permits customers that are California residents and who provide personal information in obtaining products and services for personal, family, or household use to request certain information regarding our disclosure of personal information to third parties for their own direct marketing purposes. If applicable, this information would include the categories of personal information and the names and addresses of those businesses with which we shared qualifying California personal information during the immediately prior calendar year (e.g., requests made in 2023 would receive information regarding such activities in 2022). Does Welch Workwear profile or use automated decision making?

We do not profile or use any form of automated processing on your personal information in furtherance of decisions that produce legal or similarly significant effects within the meaning of the VCDPA or other applicable US privacy law.

Does this privacy policy apply to third-party services?

This Privacy Policy does not apply to information collected by third-party websites that may be accessible through the Services. Including a link on the Services does not imply our or our affiliates' endorsement of the linked site or service.  

Use of services by minors?

Our Services are not intended for children under the age of 16, and children under the age of 16 are not permitted to use our Services. We do not knowingly collect information online from individuals under the age of 16. If we obtain actual knowledge that any information we collect has been provided by a child under the age of 16, we will promptly delete that information. If you believe we might have any information from a child under 16, pleasecontact us. We do not knowingly “sell” or “share” (as those terms are defined under the CCPA and other US privacy laws) the personal information of consumers under 16 years of age.  

Does Welch Workwear use a third-party payment service?

We use a third-party payment service to process payments made through the Services. If you wish to pay through the Services, your personal information will be collected by such third party and will be subject to the third party’s privacy policy rather than this Privacy Policy. We have no control over and are not responsible for this third party’s collection, use, and disclosure of your personal information.

Notice of financial incentive

Welch Workwear may offer you certain loyalty and rewards programs that may be considered financial incentive programs under California privacy law, which can result in different prices for Welch Workwear products and merchandise, such as our military and first responder program. Eligible members of our discount programs may save via a discount on eligible products, the details of which will be provided at the time you sign up for the program. Participation in our discount programs is voluntary and requires your prior opt in consent. If you elect to participate, you may do so through the “Account” page or by performing certain voluntary interactions with our website. While we will not discriminate against you for exercising your privacy rights, if you request the deletion of your data associated with this program, any accumulated points will be deleted, and you may not have access to continued discounts and benefits of membership. You may cancel your membership at any time, subject to certain restrictions.

Welch Workwear requires minimal personal information in order to provide the price discounts to eligible participants, including the following categories of personal information: identifiers, California customer records personal information categories, and professional and employment-related information as further detailed in the Section “What Types of Personal Information Does Welch Workwear Collect” above. Welch Workwear uses the personal information of eligible participants to provide discounts and to further our business in accordance with our Privacy Policy. The value Welch Workwear receives from our discount programs (and its incidental collection of consumer personal information) includes the profits generated by, and the consumer goodwill and consumer relationship established through the offering of the Welch Workwear discount programs and taking into account the costs to Welch Workwear to provide and maintain our discount programs. The estimated value will be disclosed when you sign up or are approved for the applicable program.

Cookies and Other Trackers

Cookies are files placed on your computer or mobile or handheld device (such as smartphones or tablets) when you visit certain web pages or use certain mobile applications. They can be used to “remember” when your computer or device accesses this Site. Cookies are stored in your browser. The cookie will help the Site or another website recognize your device the next time you visit. Most cookies won’t collect information like a name or email address that directly identifies you as a person and will instead be used in efforts such as collecting more general information, such as how visitors arrive at and use a Site. Clear GIFs are tiny graphics with a unique identifier, similar in function to cookies. In contrast to cookies stored on your device, clear GIFs are embedded invisibly on web pages. We may use clear GIFs (a.k.a. web beacons, web bugs, or pixel tags), in connection with our Site and with cookies to, among other things, track the activities of Site visitors, help us manage content, compile statistics about Site usage, and engage in targeted advertising. We and our third-party service providers also use clear GIFs in our HTML emails to help us with things like tracking email response rates, identifying when our emails are viewed, tracking whether our emails are forwarded, and customizing email or Site content.

We do not control these third parties’ tracking technologies or how they may be used. How will you know if this privacy policy is updated?
